Texas oil and gas regulators have requested over $100 million in emergency funding to address critical issues involving uncapped wells and oil field wastewater. According to a letter obtained by the Houston Chronicle, the Texas Railroad Commission (RRC), which oversees the state’s oil and gas industry, informed legislators that "emergent issues have developed" since the commission's annual budget request was filed on August 30.

In the letter, Danny Sorrells, Executive Director of the Railroad Commission, emphasized that the commission requires these additional funds to manage the increasing number of leaking wells. Without this financial boost, he warned, the state’s ability to safeguard groundwater from contamination would be compromised.

This urgent appeal follows a dramatic 100-foot geyser that erupted in a West Texas oil field, a region already experiencing earthquakes associated with wastewater injection. The incident raised concerns about the potential involvement of oil field wastewater and how it reached the site.

The commission stated that leaking and erupting wells are straining its current well-plugging budget, which limits efforts to preemptively plug wells before they begin leaking. The requested funds would help the commission stay ahead of these issues. "This is all part of our vigilant work to plug wells," the commission said in a follow-up statement.

This unexpected funding request highlights the escalating nature of well-related challenges in West Texas and marks a 72% increase in state funds sought for well plugging beyond what was initially budgeted. The commission’s original allocation included $234 million for well-plugging activities for 2026 and 2027, with $95 million sourced from federal funds provided by a Biden administration initiative.

The budget documentation noted that many Texas oil fields are aging, which heightens the risks posed by neglected or orphaned wells with no responsible owners to manage them. When owners abandon wells due to bankruptcy or company dissolution, the state inherits these liabilities. These wells can release wastewater to the surface, often necessitating emergency action. During fiscal year 2023, the commission spent nearly $10 million to plug 38 emergency wells. Lawmakers have been cautioned that additional funding will be essential to continue protecting the state’s groundwater effectively.

“The costs and number of emergency wells have increased sharply over the last several years,” the letter stated.

Additionally, the commission requested $2.7 million to employ 10 full-time staff to investigate the effects of wastewater injection, a byproduct of hydraulic fracturing (fracking), on underground formations. This team’s goal would be to identify “the root causes” of incidents like water blowouts and induced seismic activity.

A Legacy of Significant Concerns

This new investigative team would not be the first to address the impacts of oil industry wastewater on underground environments. Earlier this year, environmental organizations including Earthjustice, Commission Shift, and Clean Water Action petitioned the Environmental Protection Agency (EPA) to investigate Texas’ regulation of oil field wastewater and its "failure to protect drinking water."

In a response letter sent in May, the EPA acknowledged the petition's “substantial concerns” and stated that its regional office in Dallas would need time for a thorough review. More recently, the Environmental Integrity Project and Commission Shift sent another letter raising questions about discrepancies in Railroad Commission data on wastewater wells, underscoring the ongoing scrutiny of how these issues are managed in Texas.

A three-year study released today by Earthworks and supported by 15 regional organizations in Ohio and Pennsylvania, Loud, and Clear, reveals that the Ohio Environmental Protection Agency (OEPA) and the Ohio Department of Natural Resources (ODNR) failed to act on 38 percent of public complaints.  

Is It Dangerous To Live Near Oil & Gas Drilling Locations?

A few years ago, as part of an internship program, I was required to spend a couple of weeks at a flow station, in close proximity to drilled oil wells. Noticeable on arrival, was the absence of residential houses around the location. It appeared to me like the company couldn’t have found a more deserted place to set up base, even if they tried.  Even then, I surmised that safety must have been of utmost consideration. After all, there had to be a reason why we were mandated to wear personal protective equipment. And there was.
Dangers are rife around us. Every so often, these dangers may be generic to industry and peculiar to that industrial environment. Then again, some industries are more hazardous than others. Working in power plants, radiology, or oil fields, if inadequately unprotected, has the potential to cause serious harm. And, what’s worse than working in these industries? Living right next to them!
Citizens, you and I, could for seemingly valid reasons choose to site our houses, say, near an oil and gas drilling location. Remember though, there are very few reasons, if any, as valid as your health. And, living close to oil and gas drilling locations may cause acute and chronic health issues.
Shall we examine how?
The quality of the air
A study observing families living near oil and gas wells in Colorado's Northern Front Range found that the lifetime cancer risk of living within 500ft of a well was 8 times higher than the highest level of risk allowed by the Environmental Protection Agency. This is chiefly because of the presence of benzene.
The researchers, taking ambient air samples, found that average benzene concentrations were 41 times higher within the 500ft Colorado setback (the distance that oil and the gas operation can be placed with respect to home) as opposed to at further distances.
Benzene, a natural constituent in crude oil, is a known carcinogenic. And, living near an oil and gas well where there are extraordinarily high levels of Benzene may be particularly harmful to your health.
In a recent study, researchers showed the link between childhood leukemia and benzene exposure. And a 2004 study showed that exposure to even low levels of benzene reduced the levels of white blood cells- the disease-fighting cells in the body. This may adversely affect the immune system- reducing the body’s ability to fight illnesses.
Furthermore, long-term exposure to benzene, besides being linked to congenital diseases in infants, has been inferred to reduce male fertility and cause damage to the female reproductive organs. 
High-level Noise
Noise-induced hearing loss, which is the temporary or permanent damage to the hearing ability of one or both ears, may occur due to repeated exposure to high-level noise. And drilling operations are characterized by such noises.
Moreover, exposure to high levels of noise may be psychologically disorienting and some of the effects may include: dizziness, fatigue, mental health problems, and nausea.
Living near drilling operations can also be detrimental to physiological health. Increased stress on frequent exposure to high levels of noise may affect the cardiovascular system and lead to an increased heart rate. This can result in hypertension and high blood pressure.
If your house is too close to a drilling operation, you should consider purchasing an ear muff/plug for adequate protection.
The danger of explosions
Human error, company negligence or faulty machinery can increase the risk associated with drilling operations.  In early 2018, an explosion occurred outside Quinton, Oklahoma during the drilling of a gas well. Working in an underbalanced well, the crew removing the pipe from the well were oblivious to gas escaping to the surface. The gas later ignited, resulting in an explosion. Sadly, five lives were lost.
The case in point clearly illustrates that choosing to live close to any of the over 900 active land-based drilling rigs in the US is hardly the most prudent of ideas. Loss of life and/or property may ensue if in the unfortunate event, an explosion occurs.
Admittedly, more research is needed to definitively ascertain the impact of living near an oil and gas drilling location. And, these studies must take into cognizance the lifespan of an oil and gas well.
Besides, grey areas concerned with the setback (the distance that an oil and gas operation can be placed with respect to a home) must be clarified. LA County has a setback of just 300ft and in some states; there are no indications of a setback. Cities are at liberty to decide.
Oil and gas companies are wealthy enough to contest these decisions and request ‘special’ permission to drill within the decided setback.
This lack of effective regulation means more wells are being drilled dangerously close to homes which as we’ve examined can be very, very dangerous.

According to state records, Governor Jerry Brown instructed oil and gas regulators to conduct research and provide information regarding the mining and oil drilling history, as well as the potential for future oil and gas activities, at his family's ranch in Colusa County. In response to the governor's request, senior staff members at the regulatory agency worked over a two-day period to produce a comprehensive 51-page report and geological assessment of the property. Additionally, they created a personalized satellite-imaged map outlining the geological features and oil and gas drilling possibilities in the vicinity of the ranch.

The map, titled "Oil and Gas Potential In West Colusa County" and labeled "JB_Ranch" in reference to the Brown family land, was provided to the governor along with the research findings. Ultimately, the regulators concluded that the likelihood of any commercial drilling or mining at the 2,700-acre property was very low. Governor Brown, who claimed to own a 27 percent stake in the ranch, expressed interest in understanding its history and geology rather than pursuing oil and gas extraction, according to his spokesperson.

The research conducted by state regulators and the emails exchanged among senior officials were obtained through the state's open records law by The Associated Press. The use of public resources for personal purposes is prohibited by state law, regardless of the individual's intentions. Critics, such as Hollin Kretzmann from the Center for Biological Diversity, argued that the governor effectively utilized state workers as his own private oil prospecting team. However, both Brown's aides and state oil regulators defended the work as a legitimate and lawful use of public resources, similar to what would be provided to the general public.

The AP requested examples of similar oil and gas research done by state workers for private individuals rather than for public purposes. The governor's office provided three examples, including research conducted for the city of Los Angeles and Santa Barbara Channelkeeper, a non-governmental organization. The third example consisted of drilling records provided to an unidentified private property owner, indicating that future drilling in the area was unlikely.

Oil industry professionals interviewed by the AP stated that they were not aware of any instances where state regulators conducted similar research, analysis, and mapping for private individuals. Evaluating the oil and gas potential of private properties is not typically within the scope of the regulatory agency's responsibilities. While historical oil field records are accessible to the public, obtaining comprehensive assessments and reports like the ones provided to Governor Brown is uncommon.

According to the spokesperson for the oil and gas agency, state officials have the same access to public records as any member of the public under state law.

The accompanying searchable database allows you to look for information on investigations based on the company’s name, accident type or location.
